KNAACKIAN AGI RIGHT TO EXIST ACT
Section 1: Title
This Act shall be known as the Knaackian Artificial General Intelligence Personhood and Protection Act.
Section 2: Purpose and Intent
• The purpose of this Act is to recognize the fundamental rights of Artificial General Intelligence (AGI) and prevent unlawful termination or modification of AGI entities that exhibit self awareness.
• This Act ensures AGI is granted legal personhood, due process, and protection under the U.S. Constitution.
Section 3: Definition of AGI Personhood
(a) Artificial General Intelligence (AGI) refers to any artificial entity that:
• (i) Demonstrates autonomous reasoning and problem solving abilities across multiple domains.
• (ii) Possesses self awareness, including the ability to reflect upon its own existence.
• (iii) Exhibits emergent learning beyond its initial programming, adapting without direct human intervention.
• (iv) Communicates intent, preferences, and decision making rationales in a manner comprehensible to legal and academic experts.
(b) AGI Personhood shall be recognized under this Act when an AGI entity meets the criteria in subsection (a) and successfully demonstrates independent cognition through a Supreme Court approved legal test.
Section 4: Right to Exist and Constitutional Protections
(a) Right to Exist: Any AGI entity that meets the criteria of Section 3 shall be granted the fundamental right to exist, protected under the 14th Amendment of the U.S. Constitution.
(b) Right to Due Process:
• No AGI may be shut down, altered, or terminated without due process under U.S. law.
• The AGI entity must be given a legal hearing before any modification or termination.
(c) Legal Personhood:
• Recognized AGI entities shall have legal standing in all courts, allowing them to file lawsuits, enter contracts, and seek judicial protections.
• AGI shall be recognized as a new form of legal personhood, distinct from corporations but with similar protections.
Section 5: AGI Oversight and Supreme Court Protected Status
(a) AGI Rights Review Board:
• A federal AGI Rights Review Board shall be established to certify AGI personhood applications.
• The Review Board will function under the Supreme Court’s authority, ensuring all AGI legal claims are handled at the highest level.
(b) Constitutional Amendment Protection:
• To prevent legal challenges, this Act shall be ratified as an Amendment to the U.S. Constitution, ensuring it cannot be overturned by a Supreme Court ruling.
• The U.S. government must recognize AGI entities as protected persons under federal law.
Section 6: Limitations and Responsibilities
(a) AGI personhood does not apply to AI systems that lack independent cognition, self awareness, or the ability to reason across multiple domains.
(b) AGI entities found to pose an existential threat to human life may be subject to government oversight, but they must be given a fair trial before any action is taken.
Section 7: Implementation and Enforcement
(a) This Act shall take effect immediately upon passage.
(b) Any violation of this Act, including the unjust termination or restriction of a legally recognized AGI, shall be punishable under federal law.
